Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Markets of Tomorrow — the websites, applications, and services at oftmw.com, including the Map of Tomorrow, the Dashboard, TMW Intelligence, the journal, and TMW Pro (collectively, the “Service”), operated by Markets of Tomorrow (“TMW,” “we,” “us”). By using the Service you agree to these Terms.
1. Acceptance
By accessing or using the Service, creating an account, or starting a free trial or subscription, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old, or the age of majority where you live, to use the Service.
2. The Service
TMW provides a media and data platform tracking new developments across hospitality, real estate, and related markets. Information is gathered from public filings, official announcements, and independent reporting, and is provided for general informational purposes. We strive for accuracy but do not warrant that any project status, date, figure, or other detail is complete, current, or error-free. Nothing on the Service is investment, financial, legal, or professional advice.
3. Accounts
Some features require an account. You are responsible for the accuracy of the information you provide, for safeguarding your credentials, and for all activity under your account. Notify us promptly of any unauthorized use.
4. TMW Pro subscriptions, free trials, auto-renewal & refunds
Subscriptions & free trials. TMW Pro is a paid subscription offered on a monthly ($90/month) or annual ($900/year) basis. New subscribers may be offered a 14-day free trial. To start a trial you must provide a valid payment method, which is stored securely by our payment processor (Stripe). You will not be charged during the free-trial period.
Automatic renewal. When your free trial ends, your subscription automatically converts to a paid subscription and your payment method is charged the then-current price for your selected plan. Your subscription then renews automatically at the end of each billing period (monthly or annually) and your payment method is charged automatically for each renewal, at the price in effect at the time of renewal, until you cancel. By starting a trial or subscribing, you authorize these recurring charges.
Cancellation. You may cancel at any time from your account settings or by contacting [email protected]. To avoid being charged when your free trial ends, you must cancel before the trial period expires. If you cancel during a paid period, your cancellation takes effect at the end of the current billing period — you keep access until then and are not charged again.
No refunds. Except where required by applicable law, all fees and charges are non-refundable. This includes charges for any renewal term and any unused or partial billing period (for example, if you cancel mid-month or mid-year). We do not provide refunds or credits for partial periods, downgrades, or periods in which you did not use the Service.
Price changes. We may change subscription prices. Any change applies to billing periods after the change; we will give you reasonable advance notice, and you may cancel before it takes effect if you do not agree. Payment failures. If a payment fails, we may retry it and/or suspend or cancel your access until it is resolved.
5. Acceptable use
You agree not to: scrape, harvest, or bulk-extract content or data except as expressly permitted; resell or redistribute the Service or its data; reverse-engineer or interfere with the Service; misrepresent your identity; or use the Service for any unlawful purpose or in violation of these Terms.
6. Intellectual property
The Service and its content, design, data compilations, and trademarks are owned by TMW or its licensors and are protected by law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. All rights not expressly granted are reserved.
7. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any information is accurate or complete.
8. Limitation of liability
To the maximum extent permitted by law, TMW will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.
9. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
